The National Assembly of People’s Power approved the new Housing Law, a regulation that updates the legal framework of the sector, expands the rights of owners and incorporates new forms of management to address the housing deficit.

Main New Features:

1. Recognition of the right of natural persons to own up to two homes, not counting the one intended for rest or summer when it is legally recognized as such.
2. It expands the possibilities of transferring, donating, exchanging or assigning parts of a home, eliminating various administrative authorizations that previously limited these operations.
3. It allows owners of homes declared to be in a state of ruin to transfer them to natural or legal persons for their operation.
4. It authorizes the transfer of rooms or spaces between owners of adjacent dwellings (horizontally and vertically), provided that the condition of adequate housing is maintained.
5. Eliminates the confiscation of housing for permanent departure from the country.
6. It eliminates the obligation that heirs had to report, within one year, the start of the process of awarding a home that had been left without occupants.
7. It also makes sales contracts more flexible by allowing the parties to freely agree on the clauses and conditions they deem appropriate, provided they do not contradict the law or public order.
8. It regulates the granting of the real right of superficies to build housing on barren land.
9. It authorizes buildings intended for productive activities within residential properties, after obtaining the corresponding licenses.
10. The administrative authorization before the National Institute of Territorial Planning to cede, for consideration or not, rooftops or vacant lots is eliminated.

11. The owner of a house may exchange it for two houses, provided that he does not own another property.
